Photographer’s Terms of Service Agreement
This Agreement (“Agreement”) is entered into between (“Photographer”) and (“Client”) for the provision of photography services. By booking the Photographer, the Client has agreed to the terms outlined below.
1. SERVICES PROVIDED
The Photographer agrees to provide professional photography services for the event/session described below:
- Event/Session Type: [Wedding/Engagement/Family Portrait/Product Shoot, etc.]

- Location
The Photographer will provide the Client with digital images delivered via an online gallery or USB drive, as agreed.
2. PAYMENT TERMS
- Total Fee:
- Deposit: A non-refundable deposit of 50% is due at the time of booking to secure the session date.
- Balance: The remaining balance is due no later than 1 day before the event or session date.
- Payment can be made via payment methods, e.g., bank transfer, Venmo/Apple Pay, debit/credit card].
3. CANCELLATION AND RESCHEDULING
- Client Cancellations: If the Client needs to cancel, the deposit is non-refundable. Cancellations must be made in writing.
- Photographer Cancellations: If the Photographer is unable to attend due to unforeseen circumstances (e.g., illness, emergency), the Photographer will either reschedule the session or provide a full refund of the deposit and any paid balances.
- Rescheduling by Client: If the Client wishes to reschedule the event or session, the Photographer will make reasonable efforts to accommodate the change, subject to availability. Additional fees may apply depending on the rescheduled date.
4. DELIVERABLES
- The Photographer will provide the Client with [insert number] of professionally edited, high-resolution images.
- The final images will be delivered within 1-2 weeks after the event/session.
- The images will be provided via an online gallery, USB drive, or any other method previously agreed upon.
- The Client is responsible for downloading the photos within 60 days of the gallery being made available.
5. COPYRIGHT AND USAGE
- The Photographer retains full copyright over all images created and delivered. The Client is granted a license to use the images for personal use only, including printing, sharing, and displaying.
- The Photographer reserves the right to use the images for promotional purposes, including but not limited to, portfolio display, social media, website, and marketing material, unless explicitly stated otherwise by the Client in writing.
- The Client is not permitted to alter or edit the images without the Photographer’s consent.
6. CLIENT COOPERATION AND IMAGE RIGHTS
- The Client agrees to cooperate with the Photographer and ensure that any necessary permits or permissions are obtained for the shoot.
- The Photographer will not be responsible for any damage or loss to personal property during the shoot.
- The Client grants the Photographer permission to use any location-related imagery and agrees to obtain consent from others present for photos.
7. LIMITATION OF LIABILITY
- The Photographer will take all reasonable steps to ensure high-quality images, but is not responsible for circumstances beyond their control (e.g., weather, technical malfunctions).
- The Photographer’s liability for any damages will be limited to the amount paid by the Client for the session.
8. ARCHIVAL AND STORAGE
- The Photographer will store the images for a period of 1 year from the session date. After this period, the images may be deleted. It is the Client’s responsibility to download and back up their images.
9. INDEMNIFICATION
- The Client agrees to indemnify and hold the Photographer harmless from any claims, damages, or losses arising out of the Client's use of the photographs.
10. AGREEMENT AND SIGNATURE
By paying the session fee in full, the Client acknowledges and agrees to the terms outlined in this Agreement.
This contract is legally binding. Both parties should keep a signed copy for their records.
